CHESAPEAKE — A portion of active farmland in southern Chesapeake has been converted from residential to agricultural land.
City Council last week approved a request from Ben Hubbard to rezone 22 acres of an 84-acre property at 4216 Ballahack Road from residential to agricultural use. Hubbard owns the land with Mary Hubbard.
Ben Hubbard told council members last week he’s owned the property for 40 years and that it’s actively used for farming. But when he purchased it, 22 acres were zoned for residential use, which has limited the ability to use the land for agricultural purposes. So last week’s vote gave the property uniform agricultural zoning.
Under the agricultural zoning, property owners are limited in how much housing they can develop on their property. In this case, the property owners would be limited to no more than five residential lots. However, city staff wrote in the application that the applicant has no plans at this time to develop the land.
Much of the surrounding area is considered open space or agricultural land, but the property is adjacent to six other properties that each contain a single-family house.
Chesapeake resident Vic Nicholls commended the request on behalf of the dozens of residents in southern Chesapeake who have consistently pushed for years to stop overdevelopment and encroachment into the city’s rural area. The Agricultural Advisory Commission also reviewed the application in May and supported it because it preserves agricultural land.
City leaders have taken heed to those concerns and have worked to boost funding to the city’s existing open space preservation program, which allows the city to purchase development rights to provide some compensation for landowners while also ensuring the land remains open or used for agriculture.
Chesapeake’s fiscal 2026 budget includes about $3.5 million of funding for the program — an increase from the $3.2 million budgeted the previous year.
