It doesn’t matter where the CRJ stopped. They were stopped. The onus is on the aircraft that is moving to make sure they have wing clearance to taxi past. Much like what happened recently in SLC. Delta said they could get past the other aircraft to get to the runway intersection for takeoff. They misjudged, and hit the stopped aircraft.
