The Florida Supreme Court on Thursday unanimously rejected an appeal filed by a Death Row inmate convicted in the 2010 stabbing death of a Jacksonville woman.
At least in part, attorneys for David Kelsey Sparre, 34, argued that his constitutional rights were violated because the jury in his case was “not drawn from a fair cross-section of the community,” according to the Supreme Court opinion.
The opinion, written by Justice Jamie Grosshans, rejected the arguments on a series of grounds.
As an example, it said that while defendants are entitled to trial by an impartial jury chosen from a fair cross-section of the community, the U.S. Supreme Court “has repeatedly emphasized, this right does not guarantee that the jury actually selected — the petit jury — will always mirror the relevant community.”
Sparre was convicted in the murder of Tiara Pool, whose body was found in her apartment. She had been stabbed about 90 times, and items had been taken from her apartment, according to the opinion.
