Patrick Henry Mall shooting: Man tackles another, disarms him and shoots him multiple times, police say

A Newport News man has been charged with second-degree murder in the fatal Saturday morning shooting at Patrick Henry Mall.

Gary Carlton Moore, 26, also faces gun charges in the slaying of Diamante Tre’von Neal, who was also 26.

It was a busy day of shopping over Thanksgiving weekend when multiple 911 calls came in about shots fired at about 10:51 a.m.

When police arrived, Moore was on the floor inside of New Square, a clothing store on the west side of the one-story mall.

He had been shot multiple times. He was taken to Riverside Regional Medical Center, where he was pronounced dead at 11:23 a.m.

Moore remained on scene and acknowledged being the shooter.

He told officers that Neal “had threatened to kill him, and he had shot him in self-defense,” according to a police affidavit filed in Newport News General District Court.

Moore was taken into custody and declined to speak further to detectives. But police obtained video surveillance footage from New Square.

In the footage, Moore is inside the store while Neal enters and begins to look at clothing along the wall.

“Moore then approaches Neal and the two begin what appears to be a conversation,” the affidavit said. “A short time later, Moore can be seen attempting to tackle Neal and a short struggle ensues.”

Moore took Neal’s gun during the ensuing struggle, then pulled his own firearm that had previously been concealed, the affidavit said.

Moore was then holding two handguns — his own in his right hand and Neal’s in his left. Moore fires the gun in his right hand several times.

According to the affidavit, Neal was “in the process of retreating after being disarmed” when Moore opened fire.

In a news conference after the shooting on Saturday, Newport News Police Chief Steve Drew said the two men had a prior altercation near the food court at the mall and then “ran into each other again” in the store.

It wasn’t clear whether they previously knew each other.

Moore, of Hamilton Drive in Newport News, is charged with second-degree murder, using a firearm in a felony, carrying a concealed weapon without a permit and shooting in an occupied building.

After the shooting, police seized two firearms, a knife, multiple cell phones, a wallet and multiple cartridge casings from the scene.
